Kirsty Gomersal

Kirsty is a director in the Business Compliance & Defence team.  She specialises in environmental and health and safety litigation along with issues relating to road traffic, food safety, trading standards, waste and water pollution and licensing.

Kirsty advises clients on a wide range of compliance and risk management issues and has represented companies and individuals in coroner's inquests and investigations, prosecutions and other enforcement actions by the Health and Safety Executive and Environment Agency. Kirsty has conducted appeals against enforcement notices as well as other decisions made by regulatory bodies including judicial review proceedings in the environmental arena.

Examples of Kirsty’s work include:

• Advising a multinational chemical company on environmental and health and safety issues in a multi million dollar claim arising from the sale of one of its business units.
• Advising one of the main parties involved in the Potters Bar train derailment.
• Representing a number of companies in relation to prosecutions for alleged breaches of trade effluent consents and other pollution related incidents.
• Advising clients in relation to alleged breaches of Waste Management Licences and the enforceability of provisions in Waste Management Licences.
• Advising a number of companies regarding packaging matters including registration requirements and prosecutions for breaching regulatory requirements.
