The expense in time and cost of a full blown and formal dispute is always a factor to be taken into account as well as the many risks involved, eg even if you win, will you be able to recover what’s due to you? Will your evidence be accepted by the Tribunal?

It is for good reason that most cases settle at one stage or another. You may also want to continue a fruitful relationship with the other party and a proper trial would destroy that. If you can’t settle by discussion, the more formal arena of mediation could help to achieve it for you.

Unlike the formal process of adjudication, arbitration, and the courts, the object is to reach agreement and you can agree whatever terms you like in mediation by way of settlement.
