As matters in this area benefit from the input of those with the technical knowledge of a non-contentious trust and estate practitioner and those familiar with the Court process and litigation, our team draws on the expertise of both contentious and non-contentious lawyers. We are therefore able to draw on resources with the appropriate skills to meet the needs of the client.

 

The team has recently acted on a number of high profile and leading cases in the area of contentious trust and probate and matters with claims involving:

 

  • Challenges to the construction and content of Wills
  • Claims against an estate arising out of the Inheritance (Provision for Family and Dependants) Act 1975
  • Claims arising from the use of Enduring Powers of Attorney
  • Disputes arising through the administration of trusts in the estate, including pension trusts.

We are conscious that the costs of such claims can seriously diminish the size of an estate or trust. Therefore, we will look to resolve disputes by way of alternative dispute resolution such as mediation.

 

Where such alternative means of resolution are not appropriate we have the skills and experience to conduct these complex matters through the Courts.
