Unfair dismissal qualifying period to be extended to two years

George Osborne has announced firm plans to extend the qualifying period for unfair dismissal from one year to two years.  The change is expected to take place from 6 April 2012.  This change was initially announced back in January under the 'resolving workplace disputes consultation'.  The government projects that this change will reduce the number of tribunal claims by 2000 per year.  'Day one' rights such as the right not to be discriminated against will be unaffected.

 

In addition, from April 2013 the government plan to introduce fees for employment tribunals.  The hope is that businesses will be encouraged to take on new people without the fear of vexatious tribunal claims.  The government has not yet announced what the fees will be.  There has been much speculation in the press about the level of the fees but as yet this has not been announced.  Trade Unions will no doubt be ready and waiting to comment on any fee put forward.
