Cobbetts’ international arbitration team is a distinct area of specialism within the dispute resolution group, which has 15 partners, 6 associates and 34 solicitors, who provide a wealth of experience and enable us to resource all claims or disputes at the appropriate level depending on complexity, cost and client preference.
We have the resources, expertise and capability to act in complex, high-value and multi-party international arbitrations, pursuant to a variety of rules including UNCITRAL, LCIA, ICC, AAA, ICDR, ICSID, Swiss Rules and SCC Institute.
We cover almost every industry sector including international trade and investment, financial services, banking, power, oil and gas, telecoms, construction, media and technology, pharmaceutical, engineering, infrastructure, energy, insurance, transport and shipping.
We have in-depth knowledge of the UK and international arbitral institutions, as a result of our active participation in and membership of such organisations. For example, many of our junior lawyers are members of the Young International Arbitration Group (YIAG).
Specific examples of Cobbetts’ arbitration experience include:
• Claim relating to a $100m loan agreement which involved a $50m arbitration in the LCIA, injunctive action in Cyprus and proceedings in Russia.
• Acted for a Cypriot holding company following the sale of a media group for US$31m. The matter involved a dispute pursuant to an LCIA arbitration clause worth US$5m and a counterclaim for breach of warranty worth US$15m.
• Acted in complex and related arbitrations under various professional indemnity insurance policies. The first arbitration consisted of allegations of fraud and dishonesty, late notification, non-disclosure and misrepresentation. The second arbitration concerned the interpretation of aggregations clauses and issues of estoppel and abuse of process. The arbitrations (worth in excess of £5m), were conducted in conjunction with 10 underlying claims in the English High Court.
