Fixed term employees will also have the following rights.

  • The right to be informed of any vacancies for permanent positions.
  • The right to request a written statement giving the reason for any perceived less favourable treatment. The statement must be supplied within 21 days of the request. If the employer refuses to provide a written statement, or the written statement supplied is evasive or equivocal, the Tribunal will have the right to draw such inferences from the employer’s conduct as it deems just and equitable.
  • The right not to be victimised or subjected to any detriment for asserting their rights under the Regulations - an employee who is dismissed for that reason will be regarded as having been unfairly dismissed.
