When does a minor element of works tip a broader contract into public procurement?

• New case law on the treatment of mixed contracts (ie. those where potential public works, services or supplies contracts are mixed with other types of contract that do not incur procurement (OJEU) obligations).
• Valuable guidance from the OGC on improperly formed (and therefore non-legitimate) framework agreements.
• New case law on what constitutes a services concession contract – highly important due to the exemption from the usual rules that services concessions enjoy.
• Guidance from the new coalition government on transparency requirements for all procurements from central government.
