Contract enforcement and landlord's remedies

 

This is the seminar to attend if you are interested in how the law can assist a party who falls victim to another party's breach.  Over the last few years we have seen an inevitable increase in contracting parties failing to comply with their obligations; such as a purchaser refusing to complete a purchase of land, or a tenant failing to pay rent.  The innocent party needs to understand the options available to it in order to consider how to make the best of the situation, whether this be forcing compliance, recovering compensation or even walking away from the deal completely.

 

In this session we will look at a range of remedies available in commercial property disputes, including:

 

  • Specific performance of contracts;
  • Damages;
  • Landlords' remedies including, forfeiture, distraint, S.6 Law of Distress Amendment Act 1908, Notices under S.17 Landlord and Tenant (Covenants) Act 1995;
  • The possible impact of insolvency on these remedies.
